Terms of Service

These terms cover chatpony.com: this website, its public demo, and buying a Chatpony licence from us.
They are not the software licence. What you may do with Chatpony once you own a copy is set out in the Chatpony Commercial License, and that document controls wherever the two touch.
1. Who we are

2. Using this site
By using chatpony.com you accept these terms. If you do not accept them, do not use the site.
You may read the site, run the demo, and talk to us. You may not attack it, overload it, scrape it at a scale that degrades it for others, attempt to reach data that is not yours, or use it to distribute unlawful, deceptive, or abusive content.
3. The public demo
The demo is provided so you can see the product working, and nothing else.
- It is shared and public. The sign-in credentials are published on the page. Anyone can read what is in it.
- It is wiped every hour, on the hour, and refilled with sample data. Nothing you put there survives.
- The chat widget on this site writes into that same demo inbox, so a message sent through it is public until the next reset, and gone after it.
Do not put personal data, credentials, customer information, or anything confidential into the demo. Do not use it as storage, as a mailbox, or as a staging area for real work.
We may reset, restrict, or withdraw the demo at any time.
4. Availability
The site and the demo are provided as is and as available. We do not promise any level of uptime, and we may change, suspend, or discontinue any part of them at any time, including the demo and this website itself.
5. Suspension and termination
We may restrict, suspend, or terminate your access to this site and to the demo if you breach “Using this site” or “The public demo”, or if your use threatens the service or the people using it.
We aim to be proportionate. Where the problem is something you can fix and waiting costs nobody anything, we will say so first. Where it is an attack, unlawful content, or an attempt to reach data that is not yours, access ends immediately and without notice.
Losing access to this site does not cancel a licence you bought. A purchased licence is governed by the Chatpony Commercial License, which terminates only on its own terms — including the cure period it gives you after written notice of a violation. The two are separate, and blocking an IP address is not a termination of your licence.
Restoring access afterwards is at our discretion. The sections on our content, warranties and liability, governing law and language survive any termination.
6. Buying a licence
Purchases are arranged by email. When you buy, the following applies.
- One purchase licenses one legal entity. Parent companies, subsidiaries, and affiliates each need their own licence, or a Group licence.
- What you may do with the software is governed entirely by the Chatpony Commercial License. Read it before buying.
- Prices are in US dollars, exclusive of any taxes, duties, or bank charges that your jurisdiction imposes on the transaction.
- Launch pricing is temporary. It is a discount off the list price and may be withdrawn or changed at any time. A purchase already completed is not affected by a later price change.
- Every purchase includes an update period. Standard includes one year of updates from the date of purchase; Lifetime and Group include them without a time limit, until we discontinue the product — a pause in releases does not end them. When an update period ends, every version you already received stays yours to run, permanently.
7. Refunds
You may request a full refund within 14 days of purchase, for any reason, by writing to hello@agilebyte.cc. No justification is needed.
A refund ends the licence granted by that purchase on the date of the refund. From then on you must stop using the software and delete your copies of the source code, exactly as the licence describes for a terminated licence.
8. Support
We answer questions as best we can, but nothing here obliges us to provide support, maintenance, or new versions. Any support arrangement beyond that is agreed separately in writing.
9. Our content
The Chatpony name, the site, its text, and its design are ours. Nothing on this page grants you a licence to them; the software licence covers the software and nothing else.
Links to third-party sites are conveniences. We do not control them and are not responsible for what they contain.
10. No warranty, and limits on liability
As far as the law allows, the site, the demo, and the software are provided without warranty of any kind, express or implied.
As far as the law allows, we are not liable for indirect, incidental, or consequential damages, nor for lost profits, lost data, or business interruption arising from your use of this site or the demo. For the software itself, the limitation in the Chatpony Commercial License applies.
Nothing here excludes liability that cannot lawfully be excluded.
11. Changes to these terms
If these terms change, the new version appears on this page with a new date at the top. Continuing to use the site after that means you accept the new version. A purchase is governed by the terms in force on the day it was made.
12. Governing law
These terms are governed by the laws of the mainland of the People's Republic of China, without regard to conflict-of-law rules. The courts with jurisdiction over our registered address have exclusive jurisdiction over any dispute arising from these terms or from your use of this site.
The Chatpony Commercial License carries the same clause for the software itself.
13. Language
This document is published in several languages. The English version is the only binding one, and it controls in the event of any conflict, discrepancy, or ambiguity with a translation.
